Strengthening Electoral Justice Through Effective Pre-Election Dispute Resolution

I joined fellow IEBC Commissioners and key electoral stakeholders at the launch of the Pre-Election Disputes Resolution Report and Case Digest for the 2022 General Election, an important resource documenting the Commission’s experience in resolving electoral disputes and strengthening mechanisms for electoral justice.

The publications highlight the critical role of effective and accessible dispute resolution mechanisms in promoting electoral integrity, accountability and public confidence in democratic processes. Timely and impartial resolution of electoral disputes is essential to ensuring that concerns raised by candidates, political parties and other stakeholders are addressed within the established legal and constitutional framework.

IEBC Chairperson Erastus Ethekon reaffirmed the Commission’s commitment to electoral justice and inclusive democratic processes, while Deputy Chief Justice Hon. Lady Justice Philomena Mwilu underscored the importance of public confidence in an electoral system that is fair, lawful and transparent.

The Registrar of Political Parties, J.C. Lorionokou, emphasized the important role of political parties in advancing electoral and legal reforms, strengthening internal democracy, complying with electoral laws and enhancing public sensitization as the country prepares for the 2027 General Election.

The report provides a valuable record of the Commission’s handling of 325 pre-election complaints during the 2022 General Election. Beyond the numbers, the cases offer important lessons on the value of impartial, timely and structured dispute resolution in safeguarding the integrity of elections.

As preparations for the 2027 General Election continue, the lessons captured in these publications provide an opportunity for electoral institutions, political parties and other stakeholders to reflect on what works, address emerging challenges and continue building public confidence in Kenya’s electoral processes. Effective electoral justice remains an essential part of ensuring that democratic participation is protected and that electoral disputes are resolved fairly and within the rule of law.
