I joined fellow Commissioners at the delivery of the decision by the IEBC Electoral Code of Conduct Enforcement Committee, chaired by Commissioner Dr. Alutalala Mukhwana, in a matter concerning the enforcement of the Electoral Code of Conduct. The decision underscored the Commission’s commitment to ensuring that all electoral stakeholders adhere to the standards of conduct required under Kenya’s Constitution and electoral laws.
In its determination, the Committee found the Member of the National Assembly for Nakuru Town East, Hon. David Gikaria, to have breached the Electoral Code of Conduct. As part of the sanctions imposed, the Committee directed him to issue a public apology and formally retract the offending remarks, issued a warning against future violations, and imposed a fine of Ksh 2.5 million payable within 48 hours. The Committee further resolved to refer the matter to the Office of the Director of Public Prosecutions (ODPP) for investigation into possible offences under the Election Offences Act.
The enforcement of the Electoral Code of Conduct remains a critical pillar in safeguarding the integrity, fairness and credibility of Kenya’s electoral process. Electoral laws and regulations exist not only to guide conduct during elections but also to promote public confidence in democratic institutions and ensure that political competition is conducted within the framework of the rule of law.
As the Commission, we remain steadfast in applying the law impartially and without fear or favors. Accountability, respect for the law and responsible leadership are essential to maintaining peaceful and credible electoral processes. The consistent enforcement of the Electoral Code of Conduct serves as an important reminder that all participants in the electoral process are expected to uphold the highest standards of integrity and responsibility.
The Commission will continue to discharge its constitutional mandate diligently, ensuring that electoral processes are conducted in a manner that protects the sovereign will of the people and strengthens public trust in Kenya’s democratic institutions.
